By purchasing a product from Pannin Technologies, LLC we are released from any and all liability associated with the use of the equipment purchased. In addition, you release Pannin Technologies, LLC from any and all liability for the loss of use, loss of profit, inconvenience, property damage, personal injury or death arising out of breach of warranty, breach of contract, delay, negligence, strict tort liability or otherwise.

 

Pannin Technologies, LLC reserves the right to correct typographical errors made on our website.

 

Should either party bring an action to enforce the terms of the Agreement, the prevailing party in such action will be entitled to recover court costs and reasonable attorneys’ fees in the judgment rendered in such action.

 

Customer consents to the jurisdiction of the Shelby County Court at Memphis, TN, or to the United States District Court for the Western District of Tennessee at Memphis for any action brought to enforce or interrupt the provision of this Agreement.

 

In the event that any action is instituted to enforce the terms of the Agreement , Customer will be liable for court costs and reasonable attorneys' fees.

 

In the event of a non-payment, Customer agrees to pay Pannin Technologies, LLC’s costs of collection, including attorneys’ fees. This agreement shall be interpreted and governed in accordance with the laws of the State of Tennessee. Each party to this agreement agrees that any suit, action, or other legal proceeding arising out of this Agreement shall exclusively be brought in the Shelby County Court at Memphis, Tennessee or to the United States District Court for the Western District of Tennessee at Memphis.
